All Don't Panic content is educational and informational only. It is not:
The content reflects the personal experience, research, and perspectives of the creator and should be understood in that context. Esoteric, metaphysical, and spiritual content included in certain programs represents personal beliefs and traditional frameworks, not scientific claims.
Your use of Don't Panic does not create a provider-patient, therapist-client, trainer-client, or any other professional relationship between you and Don't Panic or Emil Pasini. Don't Panic does not provide individualized health, fitness, nutrition, or psychological assessments or interventions.
By using Don't Panic programs, you acknowledge and accept that:
a) Physical activity carries inherent risks, including but not limited to: musculoskeletal injury, cardiovascular events, exertional illness, dehydration, and other physical harm.
b) Dietary changes carry risks, including but not limited to: nutrient deficiencies, adverse reactions, interactions with medications, and exacerbation of existing conditions.
c) Supplement use carries risks, including but not limited to: adverse reactions, medication interactions, allergic responses, and toxicity at improper doses.
d) Breathwork and meditation practices carry risks, including but not limited to: lightheadedness, hyperventilation, emotional distress, panic responses, and, in rare cases, dissociative episodes.
e) Detox and cleansing protocols carry risks, including but not limited to: adverse reactions, nutrient depletion, dehydration, organ stress, and adverse interactions with medications.
f) Emotional and psychological exercises may surface difficult emotions, memories, or psychological material that could be distressing.
You voluntarily assume all such risks and agree that Don't Panic is not responsible for any injury, illness, emotional distress, or adverse outcome arising from your use of the programs.
To the maximum extent permitted by applicable law, Don't Panic, Emil Pasini, and any directors, officers, employees, agents, contractors, affiliates, or partners shall not be liable for any:
arising out of or in connection with your access to or use of Don't Panic content, programs, website, or application, regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if Don't Panic has been advised of the possibility of such damages.
In jurisdictions where limitation of liability for personal injury is not permitted, our liability shall be limited to the maximum extent permitted by law. Nothing in these Terms excludes or limits any right you have under consumer protection law that cannot be excluded or limited by agreement.
Total aggregate liability for any claim arising from these Terms or your use of Don't Panic shall not exceed the amount you paid to Don't Panic in the twelve (12) months preceding the claim.
By using Don't Panic, you represent and warrant that:
a) You are at least 18 years of age.
b) You have consulted with a qualified healthcare provider before beginning any exercise, nutrition, supplement, breathwork, or lifestyle program, especially if you have any pre-existing medical conditions, are taking medication, are pregnant or nursing, or have a history of mental health conditions, eating disorders, or substance abuse.
c) You are physically and mentally capable of participating in the activities described in the programs, or you have obtained medical clearance to do so.
d) You will immediately stop any activity if you experience pain, dizziness, shortness of breath, chest discomfort, or any other warning sign, and seek medical attention as appropriate.

f) You are solely responsible for your health decisions and outcomes resulting from your use of Don't Panic content.
Don't Panic is designed for adults aged 18 and older. By creating an account or using our services, you confirm that you are at least 18 years of age. If we become aware that a user is under 18, we reserve the right to terminate their account.
All Don't Panic content, including but not limited to text, graphics, images, videos, audio, software, program materials, and branding, is the intellectual property of Don't Panic and is protected by Canadian and international copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Don't Panic content without prior written permission.
Your subscription grants you a personal, non-transferable, non-exclusive license to access and use the content for your own personal, non-commercial purposes.
a) The Baseline (Free) The Baseline is a free educational program available upon email signup. Access is ongoing. Don't Panic reserves the right to modify or discontinue The Baseline at any time. The Panic Button remains free on every tier, including free accounts, and is not subject to this provision.
b) The Shift ($44 USD/month) The Shift is a paid subscription program providing access to Body, Mind, and Identity content, The Room (the member community), and scheduled live sessions. The Shift renews automatically every month and you are charged $44 USD (plus any applicable tax) each month until you cancel. The price is shown before you pay. Payments are processed by Stripe; where Stripe acts as the reseller or merchant of record for your purchase, its checkout terms also apply to the payment.
c) Cancellation. You can cancel online at any time, with no need to contact us: in the app, open Profile, tap your Tier: The Shift row, and cancel in the Stripe billing portal (enter your email and Stripe sends you a one-time login link). You can also email emil@epasini.com and we will cancel for you. Cancelling stops the next renewal. You keep access until the end of the billing period you already paid for.
d) Refunds. Monthly fees are not refunded for partial billing periods. This does not limit any right to cancel or to a refund that the consumer protection law where you live gives you and that cannot be waived (for example, a statutory cancellation, cooling-off or withdrawal period). If you think you were charged in error, email us within 30 days of the charge and we will make it right.
e) Free trial periods, if offered, will automatically convert to a paid subscription unless cancelled before the trial expires.
f) Price changes will be emailed to you at least 30 days before they apply to your subscription, with a reminder of how to cancel. If you do not cancel before the new price applies, your subscription continues at the new price.
g) Proximity (1:1 coaching). Proximity is an application-only 1:1 coaching and mentorship engagement. Pricing and full engagement terms are shared privately after an application is accepted and are governed by a separate written agreement between you and Don't Panic; these Terms apply to Proximity except where that agreement states otherwise. Proximity coaching is educational mentorship, not medical or psychological treatment, and Sections 2 through 6 of these Terms apply to it in full. Your cancellation and refund rights for Proximity are set out in that agreement, and include any cancellation rights the consumer protection law where you live gives you. Application and intake answers are handled as described in our Privacy Policy and Consumer Health Data Privacy Policy.
h) Session recordings. Live group sessions in The Room may be recorded so members can rewatch them. By joining a group session you consent to being recorded. Recordings are for members, not for public distribution. Proximity coaching calls are not recorded unless both sides agree in advance.
i) Don't Panic reserves the right to modify, suspend, or discontinue any program or service at any time with reasonable notice.
Don't Panic includes community features (The Room: the in-app member community, plus scheduled live video sessions). By participating, you agree to:
Violation of community guidelines may result in temporary or permanent removal from the community without refund.
Don't Panic may reference, recommend, or link to third-party products, services, or websites (including supplement brands, equipment, books, and apps). These references are for informational purposes and represent personal experience unless explicitly identified as paid partnerships or affiliate relationships.
Don't Panic does not manufacture, endorse, guarantee, or assume liability for any third-party products. Your purchase and use of third-party products is governed by that provider's terms and policies.
If Don't Panic receives compensation for any product recommendation (affiliate links, sponsorships), this will be disclosed in compliance with applicable advertising standards.
Don't Panic strives to provide accurate, up-to-date information. However, health and wellness research evolves continuously. We do not warrant that all content is complete, current, or error-free.
Don't Panic reserves the right to update, modify, or remove content at any time without notice.
You agree not to:
Violation of these terms may result in account suspension or termination.
Deleting your account. You can delete your account at any time from Profile, then Delete account. If you have an active Shift subscription, cancel it first so you are not charged again.
Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Data we collect: Name, email, payment status (card details stay with Stripe), your program progress and Check-In answers, anything you send us through forms, and device/IP information for security. We do not run advertising trackers. Page visits are counted with cookieless, privacy-first analytics (see the Privacy Policy).
How we use it: To provide our services, communicate with you, and process payments.
Your rights: You may request access to, correction of, or deletion of your personal data at any time by contacting us.
We comply with PIPEDA (Canada) and applicable provincial privacy legislation, and with the US state and European privacy laws that apply to you. See our full Privacy Policy and Consumer Health Data Privacy Policy for details.

You may withdraw consent at any time by unsubscribing or contacting us directly.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising from these Terms or your use of Don't Panic shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.
a) Informal Resolution First. Before initiating any formal legal proceeding, you agree to contact Don't Panic and attempt to resolve the dispute informally for a period of at least 30 days.
b) Mediation. If informal resolution fails, either party may request mediation through a mutually agreed mediator in Ontario, Canada, with costs shared equally.
c) Arbitration. If mediation does not resolve the dispute, either party may submit the matter to binding arbitration in Ontario, Canada, in accordance with the Arbitration Act, 1991 (Ontario). The arbitrator's decision shall be final and binding.
d) Class Action Waiver. To the maximum extent permitted by law, you agree that any dispute resolution will be conducted on an individual basis and not as part of a class, consolidated, or representative action.
e) Your consumer rights come first. If you are a consumer and the law where you live gives you the right to bring a claim in court, to join a class action, or to have the law of your home jurisdiction apply despite an agreement like this one (for example, consumers in Ontario and Quebec, and in the European Union and United Kingdom), the arbitration clause and class action waiver above do not apply to you to that extent, and nothing in these Terms takes those rights away.
f) Exceptions. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for matters involving intellectual property infringement or data security.
You agree to indemnify, defend, and hold harmless Don't Panic, Emil Pasini, and any directors, officers, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Don't Panic reserves the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on our platform at least 30 days before they take effect.
Your continued use of Don't Panic after the effective date of any modification constitutes your acceptance of the modified Terms.
